These Terms & Conditions ("Terms") govern your access to and use of hardarx.com and the telehealth and pharmacy-fulfillment services offered through it (together, the "Services"), operated by Hard Health ("HardRx," "we," "us," or "our"). By accessing the Site or using the Services, you agree to be bound by these Terms.
You must be at least 18 years old, a resident of the United States, and legally able to enter into a binding contract to use the Services. You agree to provide accurate, complete, and current health and account information, and to update it as needed.
HardRx connects you with independent, licensed physicians for an asynchronous telehealth review, and, if a prescription is approved, arranges for that prescription to be filled and shipped by a LegitScript certified, PCAB accredited pharmacy. HardRx does not itself practice medicine or dispense medication; physicians and pharmacies in our network are independently licensed and responsible for their own clinical and dispensing decisions.
The Services are not a substitute for in-person medical care and do not create a guaranteed physician-patient relationship prior to review and approval. Content on the Site is for general informational purposes only and should not be relied upon as medical advice. Always seek the advice of a qualified health provider with questions about a medical condition, and seek emergency care immediately for chest pain, vision or hearing changes, or an erection lasting more than 4 hours.
Submitting a health assessment and selecting a plan does not guarantee that a prescription will be approved. A licensed physician independently reviews each request and may approve, adjust, or decline it based on your health information. If your request is declined, you will not be charged for that order.
Plans are billed monthly at the rate shown at checkout. A payment method is collected at checkout for age-verification purposes and is only charged once a physician approves your prescription. Unless cancelled, plans automatically renew each month at the then-current listed rate until you cancel through your Patient Portal.
Approved orders are shipped free via standard discreet shipping, typically within 24 hours of approval; optional overnight shipping may be available for an additional fee. Delivery timeframes are estimates and may vary based on your location and pharmacy processing volume.
You may cancel, pause, or adjust your plan at any time through your Patient Portal, effective for your next billing cycle. Because HardRx is a prescription medication, approved and shipped orders are generally not eligible for return once dispensed, consistent with standard pharmacy practice and applicable law. If you were charged in error or have concerns about an order, contact us using the details below.
You agree to use the Services only for their intended purpose, to provide truthful health information, and not to misuse, resell, or redistribute any medication received through the Services. You agree not to attempt to access another user's account or interfere with the Site's normal operation.
All content on the Site, including text, graphics, logos, and product imagery, is the property of Hard Health or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute Site content without prior written permission.
To the fullest extent permitted by law, Hard Health and its physician and pharmacy partners shall not be liable for indirect, incidental, or consequential damages arising from your use of the Services. Nothing in these Terms limits liability that cannot be limited under applicable law.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, unless otherwise required by the law of your state of residence.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
